How long after filing
bankruptcy will the creditors stop calling?
When a creditor or bill collector becomes
informed of a filing for bankruptcy protection, it must
instantly discontinue all collection efforts. Once you file the
bankruptcy petition, the court mails a notice to every one of
the creditors listed in your bankruptcy schedules. This
typically requires a couple of weeks. Creditors will
additionally discontinue calling if you notify them that you
filed the bankruptcy petition, and provide them with your case
number. In some cases, you or your legal representative should
get in touch with the creditor right away upon filing the
bankruptcy petition, particularly if a
law suit is pending. If a creditor keeps on using collection
tactics once informed of the bankruptcy, they may be liable for
court sanctions and attorney fees for this behavior.
